USER AGREEMENT

Notice. This is an informational English translation of the User Agreement of the online store brushespaints.ru. The original document in Russian has the sole legal force. In case of any discrepancies, the Russian version shall prevail.

This agreement, being a user agreement (hereinafter — the Agreement), is concluded between a natural person acting in their own interests or in the interests of other persons (hereinafter — the User) and IE Shishkov I.V., the holder of the exclusive right to the website https://brushespaints.ru/ (hereinafter — the "Website"), hereinafter jointly referred to as the "Parties", and defines the rights and obligations of the User and the Rightholder when using the website.

1. General terms

1.1. The use of materials and services of the Website is governed by the current legislation of the Russian Federation.

1.2. By accessing the Website's materials and starting to place an order, the User is deemed to have joined this Agreement.

1.3. The Website Administration may at any time unilaterally amend the terms of this Agreement. Such changes take effect from the moment a new version of the Agreement is posted on the website. If the User disagrees with the changes, they must refuse access to the Website and stop using its materials and services.

2. User obligations

2.1. The User agrees not to take actions that may be regarded as violating Russian legislation or international law, including in the field of intellectual property, copyright and/or related rights, and not to take any actions that lead or may lead to disruption of normal operation of the Website and its services.

2.2. Use of the Website's materials without the consent of rightholders is not permitted (Article 1270 of the Civil Code of the Russian Federation). Lawful use of the Website's materials requires conclusion of license agreements (obtaining licenses) from the Rightholders.

2.3. When citing the Website's materials, including protected copyrighted works, a reference to the Website is obligatory (subclause of clause 1 of Article 1274 of the Civil Code of the Russian Federation).

2.4. User comments and other records on the Website must not contradict the requirements of the legislation of the Russian Federation and generally accepted standards of morality.

2.5. The User is informed that the Website Administration is not liable for visits to and use of external resources, links to which may be contained on the website.

2.6. The User agrees that the Website Administration is not liable and has no direct or indirect obligations to the User in connection with any possible or actual losses or damages related to problems with order placement and fulfillment. Likewise, regarding any content of the Website, registration of copyrights and information about such registration, goods or services available on or obtained through external sites or resources or other contacts of the User entered into using information posted on the Website or links to external resources.

2.7. The User accepts the provision that all materials and services of the Website or any part of them may be accompanied by advertising. The User agrees that the Website Administration has no liability and no obligations in connection with such advertising.

3. Other terms

3.1. All possible disputes arising out of or in connection with this Agreement shall be resolved in accordance with the current legislation of the Russian Federation.

3.2. Nothing in the Agreement shall be construed as establishing between the User and the Website Administration agency relations, partnership relations, joint activity relations, personal employment relations or any other relations not expressly provided for by the Agreement.

3.3. Recognition by a court of any provision of the Agreement as invalid or unenforceable does not entail invalidity of other provisions of the Agreement.

3.4. Inaction on the part of the Website Administration in the event of any User's breach of the provisions of the Agreement does not deprive the Website Administration of the right to take appropriate action later to protect its interests and protect copyrights in materials of the Website protected by law.

4. Personal data processing

4.1. By providing personal data during registration in the Service, the User gives the Website consent to processing and use of their personal data in accordance with Federal Law No. 152-FZ "On Personal Data" of 27.07.2006 by various means for the purposes specified in this Agreement.

4.2. The Website uses the User's personal data for the purposes of: — registering the User in the Service; — placement of orders by the User in the Service; — delivery of personalized advertising to the User; — fulfillment of obligations to the User.

4.3. The Website undertakes not to disclose information received from the User. However, disclosure of information is not considered a breach of obligations when the duty of such disclosure is established by the requirements of the current legislation of the Russian Federation.
The User confirms that they have read all provisions of this Agreement and unconditionally accepts them.
